1. Purpose
This document explains Qitaat's role and the limits of its liability and of the liability of the parties who deal through it. It is read with the general terms and conditions and the section terms.
2. Qitaat is a technology intermediary
- Qitaat provides a platform and technology tools. It does not itself perform contracting, supply, maintenance, rental, quick services or partner perks, unless expressly stated in a particular transaction.
- The provider alone is responsible to the buyer for the quality of what it delivers and its conformity with the specifications and the contract, for its timing, the safety of its workers, its licences and insurance, and its compliance with the law, safety requirements and the building code.
- The buyer is responsible for the accuracy of its request, location and measurements, for giving the provider access, and for obtaining any permits it needs unless agreed otherwise.
3. What Qitaat does not guarantee
- Qitaat does not guarantee that a provider will be available for your request, that a certain number of offers will arrive, or any particular price.
- Verification and the verified badge mean the Platform reviewed the business's documents at the time; they do not guarantee the quality of its work or its financial standing. Automatic matching against public sources is not official proof.
- Ratings express the opinions of their authors, and indicators and ranking are calculated by published rules that may change.
- Guide prices, price references and budget comparisons are for guidance and bind no one.
- Suggestions from smart tools (such as request analysis, title deed reading, before-and-after photo reports and automatic translation) can be wrong, and the decision rests with the person reviewing them.
- Repair-or-replace advice, default asset lifespans, and reminders for maintenance and expiring warranties and documents are helpful alerts and do not replace technical inspection.
- Reference and regulatory information shown in the Platform is for guidance and is not legal or engineering advice.
4. Service continuity
We work to keep the Platform available and secure, but it is provided "as is" and "as available". It may stop temporarily for maintenance or updates or for reasons beyond our control, and messages from telecom providers may be delayed. We recommend you keep copies of important documents.
5. External service providers
The Platform relies on third-party services, including payment and instalment gateways, messaging and verification providers, maps and hosting. Qitaat is not responsible for the errors, outages or own terms of these services, though we will follow up with them to protect your rights.
6. Payments and escrow
Escrow amounts are held with a licensed payment service provider and are released or refunded under the payments and escrow terms and dispute decisions. Qitaat is not a bank or a lender and does not guarantee any party's ability to pay.
7. Limitation of liability
- To the extent permitted by law, Qitaat is not liable for indirect or consequential loss, loss of profit, opportunity or reputation, loss of data caused by the user's own actions, or any loss arising from a transaction between users.
- To the extent permitted by law, Qitaat's total liability to any user, for any cause, does not exceed the total that user paid to Qitaat itself in subscriptions, fees or commission in the twelve months before the event.
- Nothing above limits our liability for fraud, gross negligence or anything that cannot lawfully be limited.
8. Indemnity
The user will indemnify Qitaat and its staff against any claim or loss arising from the user's breach of the terms or the law, from content the user uploaded, or from the user's dealings with another user.
9. Force majeure
No party is in breach of an obligation if performing it is prevented by force majeure beyond its reasonable control, such as disasters, epidemics, decisions of official authorities, or failures of public telecommunications networks or electricity.
10. Owners associations
Preliminary voting, proposals and discussions on the Platform are advisory and do not replace the formal general assembly decisions taken under the law through the competent official bodies and platforms. The association manager is responsible for acting within the limits of their appointment.
11. Reporting
If you notice a violation, harmful content or unauthorised use, report it to us through the support centre so we can take the necessary action.
